EG AUCTIONS BIDDING CONTRACT
TERMS OF SALE:
1. I agree to pay in full on the day of the sale(or first banking day following the sale) the bid amount plus the buyer’s fee, with cash, certified bank draft(must clear prior to vehicle pick up), direct deposit, etransfer or wire transfer in the amount owed on any vehicle or item for which I sign a contract and/or am declared the high bidder. High bidders determined by EG Auctions. Terms are cash, certified bank draft, e transfer, direct deposit and wire transfer. We do not accept credit card for vehicle purchases, only deposits. Remaining balance on vehicles must be verified funds.
2. All bidders may be required to provide proof of means to pay for any purchases. EG Auctions retains the right to require a cash deposit before issuing a bid pass. EG Auctions has permission to obtain my credit information.
3. All vehicles and items or any other purchases are sold “As Is” and without guarantees. In no event shall EG Auctions be responsible for any guarantees. All bids are final and binding upon the drop of the hammer. There is no cooling off provision and all purchasers are responsible fully for their purchases.
4. All statements by the auctioneers and those statements printed in advertisements are believed to be correct. However, bidders are to examine all vehicles and other items before bidding and do so upon his or her opinion and/or examination.
5. EG Auctions is not responsible for correctness of year, genuineness of make, model or options, mileage or any other description of the vehicles/items. Confirmation of these items and details are the responsibility of the purchaser. You are purchasing the lot numbered item presented at the auction.
6. No vehicle or item may be removed or items from vehicle, keys, etc. until paid for in full
7. Ownership of an item passes to bidder when Auctioneer says “Sold”. At that time the new owner assumes full responsibility of the item.
8. Should any dispute in a bid arise, the auctioneer will use his judgment and his decision is final.
9. All vehicles and items must be removed from the premises by the purchaser at his own expense during scheduled times. If not removed, EG Auctions may remove and store the vehicle at the purchaser’s risk and expense.
10. A purchaser’s failure to comply with all of the conditions of the sale entitles EG Auctions and/or the Consignor to use other available remedies or courses of legal action to hold the purchaser liable. This may include the following: a) cancel the sale and retain as liquid damages all payments made by the purchaser, b) re-sell the property to a new purchaser at a private or public sale and in any such event the purchaser shall be liable for deficiency plus any incurred attorney fees or court costs and c) purchaser agrees to grant the right of immediate repossession without notice from EG Auctions or its agents.
11. EG Auctions provides Title only, unless announced otherwise. Licensing (including any emissions requirements, vehicle inspections, plates and tabs) is the responsibility of the new purchaser.
12. Statements about the vehicles on the description sheets are provided by the consignor NOT EG Auctions. All statements made by the seller are accepted as reliable. EG Auctions shall have no obligation to verify seller’s statements or claims. Any dispute regarding these statements including mileage must be made directly between consignor and purchaser without effect on the responsibility for paying for the purchase to EG Auctions.
13. If a claim of any kind is to be instituted by purchaser, EG Auctions' buyer shall submit to a mediation and mediator selected of EG Auctions' choice to resolve any dispute. Purchaser must request a Mediation Request Form from EG Auctions prior to any dispute. Any mediation will be binding upon decision. The Mediation Request Form must be submitted within 30 days of the purchase of the vehicle. If this process is not followed, no claim shall be valid. Any claim shall be with the seller as EG Auctions is to receive a commission for sale of said vehicle only.
14. In the event of a dispute, all transactions with EG Auctions may be combined together toward resolving the dispute.
15. Vehicles over 20 years old and all customized/modified vehicles are considered to have frame damage. Assume all vehicles are non-matching numbers with non-original engines, unknown or exempt mileage unless specifically described otherwise by consignor.
16. Any vehicle announced as a tribute vehicle was not originally manufactured as the vehicle it currently appears to be.
17. If any term, condition, covenant, agreement or provision of this contract or the application thereof to any circumstance shall, to any extent, be held by a court of competent jurisdiction or by any authorized governmental authority to be invalid, void or unenforceable, the remainder of the contract shall not be affected by such holding, and the remaining terms, conditions, covenants, agreements and provisions hereof shall continue in full force and effect.
18. The auctioneer may announce special circumstances that apply to the legal status of specific vehicles. These announcements are described here and are part of the contract to purchase that specific vehicle: a) May require bonding – Purchaser will be responsible for any bonding or licensing required in their own state. b) Not street legal – Purchaser understands vehicle is only suitable for off-road use.
19. BUYERS PREMIUMS:
Collectables & Household = 15%
Vehicles & Equipment = $0-$5000 = 13%, $5001-$12,000 = 10%, $12,001-$75,000 = 6%, $75,000 and up = $4000
Collector Vehicles = 11% with min of $400
NO BIDS TAKEN FROM UNREGISTERED BIDDERS. All Online Bidders MUST have a method of payment in order to be approved.
20.Memorabilia/Automobilia/Small parts/Small items purchased online will be subject to a $10 handling fee/item IF you require shipment of your items. Your items will be shipped to you C.O.D. Not all items can be shipped.
21. A non-refundable $25 registration fee will be charged to each bidder upon registration.
22. A deposit of $1000 will be charged to your credit card registered online. Balance owing may be paid via one of the above mentioned methods.
