TERMS AND CONDITIONS
1. UNRESERVED: The seller has agreed to accept the highest bid regardless of price. The Property will sell without a minimum price.
2. NO WARRANTY: The Buyer shall accept the Property as-is where-is and specifically agrees that neither the Seller, Auctioneer or Realtor makes any representations or warranties of any kind as to the condition of the Property.
3. AGENT OF THE SELLER: MaxWell Realty Canada - Pat Olchowy (Phone: 780-699-9599) acts only as an agent of the seller and not as an agent of the Buyer.
4. It is the RESPONSIBILITY OF ALL BIDDERS to inspect the property and agree to all terms of the auction. All information provided is meant as a guide only. Bidders shall have satisfied themselves as to the descriptions, location and condition of the property prior to bidding. If clarification is required, it is the bidder's responsibility.
5. GST: Purchase price is plus GST.
6. DEPOSIT: A NON-REFUNDABLE deposit payable to the MaxWell Realty Canada in the form of a bank draft or other approved payment in the amount of $30,000.00 must be provided to Pat Olchowy by April 20th, 2021.
7. PURCHASE CONTRACT: The Real Estate Purchase Contact that applies to the property will be available for inspection prior to the auction. Title(s) will be clear of encumbrances except those which are to remain on the title. All bidders agree that, should their bid be accepted, they will complete and be bound by the terms of the purchase contract. Buyer will pay the balance of the purchase price to their lawyer on or before Completion Day. Possession will be within 30 days. Note: These contracts will not be subject to any buyer's conditions.
If unknown to Ed Prodaniuk Auctions, in order to bid on the quarter section you should provide documentation that you are approved from your lender to bid up to whatever you plan on roughly bidding. Successful bidder will meet/communicate on Monday, April 19th with our Realtor, Pat Olchowy, who will complete the purchase contract and collect the deposit of $30,000.00. Balance to be paid within 30 days.
Included with the property is the house with all appliances (except washer and dryer). The washer and dryer in the heated shop go with the house.
In the heated shop the following items stay with the building: air compressor upstairs, air hose reels, all lockers, wood shelving, wood cupboards, overhead radiant heater and oil tank in the corner.
In the hog barn all the feeders, hog pens, and the electrical panel which is unhooked and at the North End stay with the barn.
All attached desks, cupboards stay with the office in the hog barn. The phone system stays with the property.
The building where the Gen Set is stays with all the Electrical panels only the Gen Set sells and will be unhooked at the panel.
The 16' x 24' office South East of the shop sells separate. The complete pressure system will be unhooked by a qualified tradesman and reinstalled in a new heated 6' x 6' shed.
The buyer of the office must contact Ed Prodaniuk Auctions two days prior to being moved so that water and power can be unhooked as the pressure system supplies the farm with the water.
The property sells "AS IS - WHERE IS". All buildings will be left in a broom swept condition. Any debris left in the buildings or yard will not be the responsibility of the seller to remove.
GST applies where applicable.
This property does not sell subject to anything, so make sure you have your financing in place.
Insurance will stay on the buildings until possession date. Early permission to enter and farm the land may be available once all funds are in place.
NOTE: There are interested parties in renting the house, shop and land.

All items must be paid for on June 15th from 9 am to 5 pm (NO EXCEPTIONS). Nothing will be permitted to leave the yard until payment clears our bank.
A 5% internet service fee will be charged on all successful internet & absentee bids to a maximum of $750 per item.

1. All sales are final. The highest bidder shall be the Purchaser and no bidder shall retract his bid.
2. Complete settlement must be made in full the day of the Auction – nothing is to be removed until complete settlement is made.
3. No person shall bid on any lot (a) of which he is the consignor; or (b) as agent, associate on behalf of the consignor.
4. Anyone issuing Ed Prodaniuk Auctions an N.S.F. cheque or stopping payment on a cheque shall pay a service charge at the rate of 24% per annum on all overdue amounts and shall pay all additional costs and expenses incurred including any Solicitor – Client costs incurred by Ed Prodaniuk Auctions in collection of any outstanding amounts owing.
5. Goods “KNOCKED DOWN” sold to the purchaser lie at his risk immediately – we are not responsible for theft or damage.
6. All merchandise sells “AS IS – WHERE IS” any description as to condition or otherwise as set forth on each piece is in no way a warranty or guarantee actual or implied.
7. The Auctioneer shall control the bidding at all times and reserves the right to not accept a bid if it is a fractional advance or if the bid is injurious to the Sale.
8. The Auctioneer reserves the right to refuse an applicant a bidding card or the privilege of bidding at anytime.
9. Any person registering shall be responsible and liable for his bid card – misuse or loss is the applicant’s responsibility.
10. If for any reason whatsoever, the Auctioneers are unable to clear title to any lot, or provide any necessary documentation required in respect of any lot, whether before or after delivery of such lot, the Auctioneers sole responsibility if any, shall be the return of any monies paid on such lot upon return of the particular lot. Any lot the subject of this paragraph shall be returned or surrendered to the Auctioneers forthwith upon demand such demand to be made at the sole option of the Auctioneers.
